Controversies

HB 881 – Whether localities need new authority to regulate gas-powered leaf blowers

Stacy Oren (Virginia Manufacturers Association) argued localities already have authority to regulate noise through noise ordinances including day and time restrictions without banning lawful equipment, while Delegate Sullivan countered in closing that localities cannot simply pass ordinances against these things and that is precisely why they need the bill.

Notable Quotes

“This bill simply allows localities to regulate. That's a different word than ban and it's in the title, it's in the text, to regulate leaf blowers if they decide to do so. We do this all the time. We relax the Dillon rule and we say here, you can do this if you want to. It doesn't tell localities to do anything and it's not even directed at all localities.”

Delegate Sullivan, bill patron (HB 881 – gas-powered leaf blower regulation) — Delegate Sullivan was responding to opposition arguments that the bill would impose a ban on gas-powered leaf blowers and burden small businesses, by explaining that the bill merely grants localities permissive authority to regulate if they choose.

Ask you to limit your remarks as best as possible while still explaining your bill. What we're going to do is start with some administrative things. We will first start by taking attendance. Madam Clerk, can you please open the row to take attendance? Thank you. We do have a quorum. All right. Again, we'll start with House Bill 1148 by Delegate Hodges. We were asked to strike this bill for the day and consider a letter. And I'll talk to the chair about the letter and the language of the letter. And striking from the docket is a recorded vote.
