Controversies

Retroactive vs. prospective approach in SB 213

Senator Mansavinas argued he was 'struggling to see how a retroactive look is going to lead, is going to reconcile it's going to fit with a health insurance rate process for folks,' citing a January 9 News Journal article about Delaware topping the list for steepest US increases in health insurance costs. Andy Lipstone acknowledged 'Senator, you're absolutely correct that it is a change in outlook' but argued the shift to backward-looking review produces actual data rather than budget projections and was partly driven by court concerns about prospective budget approval.
