Controversies

Warrant practicability for ALPR data when no vehicle description exists

Sergeant Marziano (Aurora PD) testified he could not have obtained a warrant in an April 2025 case where police had only a blurry image of a white SUV — no make, model, or plate — stating 'I don't think we would have been able to get a warrant'; Senator Amabile countered the bill includes a 72-hour warrantless window and exigency exceptions, which Marziano's testimony implied were insufficient for his case type.

Notable Quotes

“Data collection without limits becomes power without limits. If you drove to the Capitol today, someone might already know your route, any stops you made, or even if a passenger was in your car.”

Senator Zamora Wilson — Opening argument for SB 70, explaining why the bill's warrant requirement and retention limits are necessary to protect civil liberties from government surveillance via automated license plate readers.

Our agenda Today consists of four bills in order. House Bill 1035, followed by 1064, then Senate Bill 70, then Senate Bill 71.
