Wednesday, February 25, 2026·4h 29m·▶ Watch / Listen

The House Judiciary Committee advanced three bills unanimously — including measures on mortgage modifications, community property, and municipal court fairness — while spending the bulk of the hearing on a deeply contested Fourth Amendment data privacy bill (HB 1037) that drew more than 100 witnesses and remained unresolved at the hearing's close.

Controversies

Whether purchasing personal data constitutes 'state action' under the Fourth Amendment (HB 1037)

Rep. Keltie argued 'you are believing that the purchasing of a data constitutes state action, transforms private conduct into a state action. I don't believe that it does' and further contended 'Purchase of information is not a transformation. It is not a seizure. It is a transaction.' AML Bacon responded 'I'm not sure how law enforcement is not a state actor' and argued the bill is specifically about government action because 'only the government can infringe upon your liberty.'

Notable Quotes

“In the case that made it to the Supreme Court, the Camp case, a woman was accused of stealing less than $300. She could have been charged under state law or a city ordinance for the same conduct. But because she was charged in a municipal court, she faced 36 more times of a potential jail sentence and more than nine times of a higher fine.”

Rep. Javier Mabrey (HB 1134 sponsor) — Rep. Mabrey was describing the sentencing disparities between municipal and state courts that motivated HB 1134, referencing a Colorado Supreme Court case as background for the bill.

I'll just the outset note in light of the fact that there are more than 100 witnesses on 1037 and I will get to this when we get to the bill too, but I'm going to do three minute testimony. I'm not going to limit for questions on the earlier bills, but so that we can get through and hear everybody on 1037, we're going to do two minute testimony and I will do limited panels on questions. Hopefully we'll get there sooner rather than later. Let's start with House Bill 1089. Espinosa. Thank you, Mr. Chair. I'm here today as representative of House District 4, obviously, but also I sit on the Uniform Law Commission.
