Controversies

Workability of automatic and immediate adoption of all U.S. federal law as Colorado law (Section 11)

Pierce Lively argued the adoption would not be one-to-one, that things would need to be changed and that would be difficult for the courts to interpret and apply, and that 'this seems to envision this as an automatic process,' questioning how much leeway the General Assembly would have given it is a constitutional direct requirement. Emerson Sturgis countered that the General Assembly would be able to pass bills to resolve the issues that these new laws create.

Notable Quotes

“If Colorado is an independent nation, the United States Constitution no longer applies in Colorado.”

Emerson Sturgis, proponent/designated representative — Sturgis offered this as his response to staff's question about how the initiative reconciles its declaration of Colorado as an independent nation with the U.S. Constitution's Supremacy Clause (Article VI, Clause 2).
