Rep. Phillips raised concern that restraining orders connected to misdemeanor harassment charges or felonies from more than seven years ago are not addressed in the bill. Rep. Luck acknowledged 'we haven't actually discussed that' and could not definitively answer whether current permanent restraining orders based on conduct more than seven years ago would be captured, stating it would be her intent for them to be covered and that specific language would need to be developed at second reading.

“I don't think that after seven years, if it is a certain type of crime, we should continue to remind them of that bad day. And so this bill simply says that if you have had a misdemeanor that was more than seven years ago, that you don't have to report that misdemeanor unless it involved an at risk individual or a minor person, someone vulnerable, that we would need to know that because there might be a propensity there related to harming someone that is in a vulnerable situation in your care.”

House Bill 26:1090 actually has been in the works for a number of years behind the scenes. Representative Martinez and I have been talking about this since he ran a bill with former Minority Leader Rose Puglisi on some issues similar as relates to the criminal justice piece. And then he enabled me to expand it beyond just that to another thing that is concerning to me based off of some things that have come to my attention from people's experiences within the licensure program.
