Review and Comment Hearing for Initiative #282

Monday, March 30, 2026·12m·▶ Watch / Listen

The Legislative Council and Legislative Legal Services held a statutory review and comment hearing on Initiative #282, a proposed ballot measure that would authorize the state to retain and spend TABOR refund revenues equal to state K12 education funding and create positive factor funding for school districts from 2027-28 through 2036-37. Proponents repeatedly declined to answer substantive staff questions, deferring to the authors of Senate Bill 135, which they described as the initiative's legislative counterpart.

Controversies

Confidentiality of pre-bill legislative consultations vs. public initiative review

A proponent asked whether the same single-subject questions posed to initiative proponents were also posed to the legislative sponsors of Senate Bill 135. Nicole Myers stated those conversations are privileged and she could not discuss them. The proponent implied an asymmetry exists because the initiative review is public while legislative pre-bill consultations are closed; Nicole Myers confirmed the distinction is based on attorney-client privilege.
